2. Subscription Services

EverGrape offers the following subscription tiers for vineyard management:

• Small Farm — Up to 20 plots
• Medium Farm — Up to 50 plots
• Large Farm — Up to 200 plots
• Enterprise — Unlimited plots

All new accounts receive a 30-day free trial with full access to all features. No credit card required to start.

Pricing is displayed in EUR. All prices include applicable VAT for EU consumers.

3. EU Consumer Rights

Right of Withdrawal: As an EU consumer, you have the right to withdraw from a subscription within 14 days of purchase without giving any reason.

To exercise your right of withdrawal, please contact us at support@evergrape.eu with your account details.

Refunds will be processed within 14 days of receiving your withdrawal notice, using the same payment method as the original transaction.

4. Data Protection (GDPR)

We process personal data in accordance with the EU General Data Protection Regulation (GDPR).

Data Types: Account information (email, name), vineyard data (plots, activities, harvests), and usage analytics.

Legal Basis: Contract performance and legitimate interest.

Your Rights: Access, rectification, erasure, data portability, and objection to processing. Contact support@evergrape.eu to exercise these rights.

Data Retention: Account data is retained for the duration of your subscription and deleted within 30 days of account closure upon request.

5. Payment Terms

Subscriptions are billed monthly or annually, depending on the selected plan.

Payment Methods: Credit/debit cards (Visa, Mastercard) and SEPA Direct Debit, processed via Barion and GoCardless.

Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled.

Refunds: Pro-rated refunds are available within 14 days of payment as per EU consumer rights.

6. Service Terms

Service Availability: We aim for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance.

Data Backup: Your vineyard data is automatically backed up. However, we recommend maintaining your own records for critical data.

Account Suspension: We reserve the right to suspend accounts that violate these terms or engage in abusive behavior.

7. Liability

General Limitation: EverGrape's total liability is limited to the amount paid by you in the 12 months preceding any claim.

Exclusions: We are not liable for indirect, incidental, or consequential damages, including crop losses or agricultural decisions based on app data.

Consumer Protection: Nothing in these terms limits your statutory rights as an EU consumer.

8. Termination

User Termination: You may cancel your subscription at any time. Access continues until the end of the current billing period.

Company Termination: We may terminate accounts for breach of these terms with 30 days' notice.

Data Retention: Upon termination, your data is retained for 30 days before permanent deletion, unless you request earlier deletion.

9. Dispute Resolution

Governing Law: These terms are governed by Hungarian law, with EU consumer protection regulations taking precedence where applicable.

Jurisdiction: Disputes shall be resolved in Hungarian courts, subject to EU consumer jurisdiction rules.

Online Dispute Resolution: EU consumers can use the European Commission's Online Dispute Resolution platform.
